Welcome to Giftoll (“we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access and use of our website (“Platform”), products, and services (collectively, the “Services”). By purchasing, redeeming, or using our gift cards (“Gift Cards”), you agree to comply with these Terms.

If you do not agree to these Terms, please refrain from using our Platform or purchasing our Services.

1. OVERVIEW

We provide a Gift Card service where users (“you”) can:

• Purchase Gift Cards via our online platform (using Stripe Payments);
• Purchase Gift Cards by contacting us via social media (Facebook, Instagram) to receive a Stripe payment link;
• Redeem Gift Cards with our authorized vendors, displayed on our Vendor Page (“Vendors”).

2. REGISTRATION AND ACCOUNT

• You may need to create an account on our Platform to purchase, view, or manage Gift Cards.
• You agree to provide accurate and up-to-date information and to update your information as necessary.
• You are responsible for maintaining the confidentiality of your account and password.
• You agree to notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

3. PURCHASE AND PAYMENT

3.1 Payment Methods

• Purchases through our platform must be made using Stripe Payments.
• For social media purchases, we provide a Stripe payment link. Payment must be completed before Gift Cards are issued.

3.2 Purchase Confirmation

After successful payment, you will receive a confirmation email and Gift Card details.

3.3 Payment Issues

We are not responsible for payment errors caused by third-party services, including Stripe or your financial institution.

3.4 Pricing

• All prices are listed in USD (or your preferred currency if supported).
• We reserve the right to adjust prices or fees at any time.

3.5 Refunds

ALL SALES ARE FINAL. Gift Card purchases are non-refundable unless otherwise stated by us or required by applicable law.

4. GIFT CARD REDEMPTION AND USAGE

4.1 Redemption

• Gift Cards can only be redeemed with our authorized Vendors, listed on the Vendors Page of our Platform.
• Vendors are third-party merchants; we are not responsible for their services, products, or behavior.

4.2 Limitations

• Gift Cards cannot be exchanged for cash, resold, or transferred (unless authorized by us).
• Lost or stolen Gift Cards will not be replaced.
• Expired Gift Cards cannot be redeemed.

4.3 Redemption Errors

If you encounter an issue while redeeming a Gift Card with a Vendor, contact our customer support team.

5. AUTHORIZED VENDORS

• Our Vendors are businesses or merchants authorized to accept Gift Cards.
• Vendor details are displayed on our Vendor Page, and we update this information as needed.
• We do not own or operate these Vendor businesses and are not responsible for their products or services.

6. USER RESPONSIBILITIES

By accessing or using our Services, you agree:

• Not to engage in fraud, misuse, or abuse of Gift Cards;
• Not to circumvent, disable, or tamper with the Platform or Services;
• Not to violate any applicable laws or regulations;
• Not to impersonate others or use false information when creating an account.

7. INTELLECTUAL PROPERTY RIGHTS

All content, logos, designs, and text on our Platform are the property of Giftoll or our licensors and are protected by intellectual property laws. You may not:

• Reproduce, distribute, or exploit any part of the Platform;
• Modify or reverse-engineer any content or software.

8. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• WE ARE NOT RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES ARISING OUT OF YOUR USE OF OUR PLATFORM, GIFT CARDS, OR VENDOR SERVICES;
• OUR LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT PAID FOR THE GIFT CARD IN QUESTION.
• WE PROVIDE SERVICES “AS IS” AND WITHOUT WARRANTIES OF ANY KIND (EXPRESS OR IMPLIED).

9. THIRD-PARTY SERVICES

• Stripe is used for payment processing; your use of Stripe is subject to its Terms of Service.
• Vendor services are provided by independent third parties and are governed by their respective terms.
• We are not liable for issues arising from these third-party services.

10. TERMINATION

We reserve the right to terminate your access to our Platform, account, or Services if:

• You violate these Terms;
• You misuse our Gift Cards or Platform;
• Required by law or court order.

11. CHANGES TO TERMS

We may update these Terms at any time without prior notice. Updated Terms will take effect upon posting on our Platform. Your continued use of the Services constitutes acceptance of the revised Terms.
